These Terms of Use govern your use of this website, operated by Vysyonary Media ("Vysyonary Media," "we," "us," or "our"). By using this website, you agree to these terms. If you don't agree, please don't use the site.

1. Purpose of this site

This website exists to introduce Vysyonary Media's video production services, showcase our work, and let visitors submit project inquiries. It is not a self-service ordering platform — no purchase or checkout happens on this site today.

2. Submitting an inquiry does not create a client relationship

Filling out and submitting the "Tell Us About Your Project" form does not create a client relationship, a contract, or any obligation on our part to accept your project. We review every inquiry, but we may decline a project at our discretion, subject to applicable law, and submitting an inquiry doesn't guarantee a response by any particular time.

3. How client work actually begins

No client work — and no obligation on either side — begins until all of the following are in place:

• A separate, signed service agreement between you and Vysyonary Media,
• An accepted scope of work, and
• Any deposit or payment called for by that agreement.

That signed service agreement — not this website — governs all client-specific matters: deliverables, number of revisions, payment terms, deadlines, ownership of final work, any authorization to use AI tools on your project, cancellation terms, and how disputes are handled. If anything on this website ever conflicts with your signed service agreement, the signed agreement controls for your project.

4. The inquiry form and scheduling

The inquiry form on this site collects the details described in our Privacy Policy so we can understand your project and follow up. You may optionally use the "Schedule a Discovery Call" link to book time on our calendar through Google Calendar; that scheduling tool is operated by Google and subject to Google's own terms as well.

5. The Vysyon client portal

Vysyonary Media may provide active clients access to the private Vysyon client portal to track project progress, exchange files, receive updates, and access project services. Access is invitation-only and subject to authentication, these Terms, the applicable service agreement, and any additional portal terms presented to the client.

6. Payment

This public website does not contain an embedded checkout. When payment is required, Vysyonary Media may provide an approved Stripe-hosted payment link, invoice, or other payment instructions. Payment amounts, schedules, refund provisions, and deliverables are governed by the applicable service agreement, invoice, and payment processor terms.

7. Acceptable use

You agree not to use this website to:

• Submit spam, or use the inquiry form for automated or bulk submissions;
• Submit false, fraudulent, or misleading information;
• Attempt to bypass rate limits, security measures, or other technical protections on this site;
• Upload or transmit malicious code, or attempt to gain unauthorized access to our systems or data;
• Submit content that infringes someone else's intellectual property or other rights;
• Use the site for any unlawful purpose; or
• Interfere with or disrupt the site's normal operation for other visitors.

We may block, rate-limit, or refuse service to any visitor or submission we reasonably believe violates these terms.

8. Third-party services

This site relies on third-party infrastructure and services to operate, including Vercel (hosting), Supabase (database), Zapier (internal notification automation), Resend (email delivery), and Google Calendar (optional scheduling). Your use of features that involve these services may also be subject to each provider's own terms.

9. Intellectual property

The content on this website — including our branding, design, photography, and video work — is owned by or licensed to Vysyonary Media unless otherwise noted, and is shown here to showcase our work. It isn't licensed for your own use just by virtue of appearing on this site. Ownership and rights to paid client deliverables are governed by the signed service agreement for that project, not by these Terms of Use.

10. Website availability

We don't guarantee this website will be available at all times, uninterrupted, or error-free. We may update, suspend, or discontinue any part of the site, including the inquiry form or scheduling link, at any time and without notice.

11. Disclaimers and limitation of liability

This website and its content are provided "as is," without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Because this website itself is free to browse and use — no payment is made to access it — to the extent permitted by law, Vysyonary Media will not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to your use of this website. This limitation applies only to your use of the website itself; nothing in this section excludes or limits any liability that cannot be excluded or limited under applicable law. Liability arising from actual paid client services is governed separately by the signed service agreement for that engagement, not by this section.

12. Governing law

These Terms of Use are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

13. Changes to these terms

We may update these terms from time to time. When we do, we'll update the "Last updated" date at the top of this page. Continued use of the website after a change means you accept the updated terms.

14. Severability and no waiver

If any part of these terms is found unenforceable, the remaining parts stay in effect. If we don't enforce a particular term right away, that doesn't mean we've given up the right to enforce it later. Together with our Privacy Policy, these Terms of Use make up the entire agreement between you and Vysyonary Media regarding use of this website — separate, signed service agreements govern client engagements.
